ELIGIBILITY: The Walk 97.5 FM Instagram #PUTH975 Giveaway (“Sweepstakes”) is open only to legal U.S. residents age eighteen (18) years or older at the time of entry who reside or are employed in WALK 97.5 FM’s geographic listening area as defined by Nielson Audio, who have not won a prize from the station in the last sixty (60) days or a prize valued at $600 or more in the last six (6) months, and whose immediate family members or household members have not won a prize from the station in the last sixty (60) days or a prize valued at $600 or more in the last six (6) months. Unless otherwise specified, employees of Sponsor, its parent company, affiliates, related entities and subsidiaries, promotional sponsors, prize providers, advertising agencies, other radio stations serving the radio station’s listening area, and the immediate family members and household members of all such employees are not eligible to participate. The term “immediate family members” includes spouses, parents and step-parents, siblings and step-siblings, and children and stepchildren. The term “household members” refers to people who share the same residence at least three (3) months out of the year. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void where prohibited by law.
SWEEPSTAKES PERIOD: The Sweepstakes will begin at 12:01AM ET on April 2, 2018 and will end at 11:59:59 PM ET on April 13, 2018 (the “Sweepstakes Period”). Sponsor’s computer is the official time keeping device for this Sweepstakes.
HOW TO ENTER: To enter during the Sweepstakes Period, use the hashtag #Puth975 and @WALK975 on a post to receive one entry Instagram page. Only entry per user will be accepted.
ODDS: Odds of winning depend on the number of participants.
To become an Instagram account holder, go to www.Instagram.com and follow the instructions create an account. Becoming an Instagram account holder is free, but is subject to acceptance of the terms and conditions of use of www.Instagram.com. Entry must be posted by the authorized Instagram account holder at the time of entry and Instagram account must be public and not private. “Authorized Instagram Account Holder” is deemed as the natural person who is assigned to an Instagram account. By submitting an Entry via Instagram.com, entrant consents to receive from the Sponsor an Instagram comment to the Entry submitted and, if applicable, an e-mail notifying such entrant that he/she is a potential prize winner. Entry posted by a private Instagram account will not be recognized. Limit one (1) entry per social media account. Use of hashtag #Puth975 is required for Entry and constitute an entrant’s agreement to these Official Rules. Any Entry that does not include the hashtag #Puth975 will be disqualified. Multiple Entries made by an entrant in excess of the limitation as stated herein will be disqualified. Use of robotic, automatic or macro devices is not valid for Entry. Any Entry that is submitted with the use of a robotic, automated or macro device will be void. All Entries become the property of the Sponsor upon submission and will not be acknowledged or returned, and the Sponsor has the right to dispose of the Entries at Sponsor’s discretion.
WINNER SELECTION: One (1) Grand Prize Winner will be selected in a random drawing to be conducted on or about April 16, 2018 from among all eligible Entries received during the Sweepstakes Period. The random drawing will be conducted by Sponsor, whose decisions regarding all matters relating to this Sweepstakes are final and binding. Odds of winning will depend upon the number of eligible Entries received during the Sweepstakes Period.
WINNER NOTIFICATION/RELEASE: Potential Grand Prize Winner will be notified by Sponsor in a responsive comment to the corresponding Entry on or about April 17, 2018 Potential Grand Prize Winner will be required to send a direct message to the Sponsor’s account that contains the potential prize winner’s full name as it appears on his/her government-issued photo ID, email address and phone number including area code within twenty (24) hours following the Sponsor’s responsive comment to the Entry. Each entrant is responsible for monitoring his/her Instagram account(s) as may be appropriate, for prize notification or other communications related to the Sweepstakes. Sponsor shall have no liability for (i) the potential prize winner’s failure to receive notices due to the potential Prize Winner’s privacy settings Instagram or spam, junk email or other security settings; (ii) a potential prize winner’s inability to access Instagram; or (iii) a potential Prize Winner’s provision of incorrect or otherwise non-functioning contact information. The potential Grand Prize Winner may be disqualified under any the following circumstances; i) if he/she does not send a direct message to the Sponsor’s Instagram account within twenty-four (24) hours, or if the direct message is returned as undeliverable,; ii) if he/she is found to be ineligible for any reason or; iii) if he/she is unavailable or unwilling to attend the Charlie Puth: The Voicetones Tour concert on Sponsor-designated date in July, 2018. In the event the potential Grand Prize Winner is disqualified for any reason, Sponsor will award the Prize to an alternate potential prize winner in a random drawing from among all remaining eligible Entries received during the Sweepstakes Period provided a sufficient amount of time remains prior to the designated Prize Event. Upon prize forfeiture or disqualification, no other compensation will be given. The selected potential Prize Winner will not be the official prize winner until all required documentation has been returned, and eligibility has been formally verified. Sponsor is not responsible for fraudulent calls or emails made to entrants or potential prize winners not by Sponsor or Sweepstakes Administrator. The receipt by the Prize Winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. Any violation of these Official Rules by the prize winner will result in such prize winner’s disqualification (at sponsor’s sole discretion) as a prize winner of the Sweepstakes and all privileges as a Prize Winner will be immediately terminated.
ONE (1) GRAND PRIZE: Grand Prize consists of two (2) tickets to the Charlie Puth: The Voicenotes Tour concert on July 16, 2018 at Radio City Music Hall in New York City. Approximate Retail Value (ARV) of Grand Prize: $150.00. The winner is responsible for all taxes associated with prize receipt and/or use. Odds of winning Grand Prize depend on a number of factors including the number of eligible entries received during the Sweepstakes Period.
All costs and expenses associated with the Prize acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of the Grand Prize Winner. There is no substitution, transfer, or cash equivalent for Prizes, except that the Station may, at its sole discretion and to the extent permitted by law, substitute a Prize of comparable value or cash. The Prize is expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Any tickets and/or gift certificates/cards awarded as part of a prize will be subject to the terms and conditions set forth by the issuer and are valid only on the date(s) printed on the tickets or gift certificates/cards. CLAIMING PRIZE: Grand Prize winner must present valid identification and proof of age to claim prize and must sign an Affidavit of Eligibility and Liability Release and/or Hold Harmless and Indemnity Agreement, agreeing to hold WBZO, WHLI, WKJY, WALK & WWSK, its licensee(s), and the officers, shareholders, directors, employees, agents, and representatives of each of them harmless against any and all claims of liability arising directly or indirectly from the prize or Sweepstakes. Grand Prize tickets may be claimed at least twenty-four (24) hours after winning, and within thirty (30) days, at 234 Airport Plaza Boulevard, Suite 5, Farmingdale, NY 11735. Pick-up hours are Business Days, Monday through Friday, 9am to 5pm. In the event of any disagreement regarding the Sweepstakes, Winner or qualification of Winners, or adequacy or value of the prize, the decision of Connoisseur Media shall remain final.
ENTRY CONDITIONS AND RELEASE: By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsor, WBZO, WHLI, WKJY, WALK & WWSK, its licensee(s), its subsidiaries, and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Sweepstakes and/or entrant’s acceptance, use, non-use or misuse of the prize.
PUBLICITY: Except where prohibited by law, participation in the Sweepstakes constitutes winner’s consent to use by the Sponsor and its agents of winner’s name, likeness, photograph, voice, opinions and/or biographical information (including hometown and state) for promotional purposes in any media, worldwide, without further payment or consideration.
TAXES: All state, local, federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. Any Prize Winner who wins a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or acting in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Station, Sponsor, entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use, non-use or misuse of any prize. No more than the stated number of prizes will be awarded. In event that a production, technical, programming or other error causes more than stated number of prizes as set forth in these Official Rules to be claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate New York State Court located in the City of New York, New York; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Stations, and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
ENTRANT’S PERSONAL INFORMATION: Information collected from entrants is subject to Sponsor’s Privacy Policy, which is available on the Stations’ websites under the “Privacy Policy” link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained therein, shall become the sole property of Sponsor to be used, disposed of or destroyed in its sole discretion. Sponsor is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to a Sponsor Station website.
